Terms of Service

1. Acceptance of Terms

By accessing or using SentByTed's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

SentByTed provides AI-powered outbound sales pipeline management, including prospect targeting, data enrichment, email sequence creation and sending, reply management, and meeting scheduling. The service is provided on a subscription basis as described on our pricing page.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4. Acceptable Use

You agree not to use our services to:

• Send spam or unsolicited commercial email in violation of applicable laws
• Transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the integrity or performance of the service
• Attempt to gain unauthorized access to the service or related systems

5. Billing and Payment

Subscription fees are billed monthly in advance. All fees are non-refundable except as expressly stated in these terms. You may cancel your subscription at any time, effective at the end of the current billing period. We reserve the right to change our pricing with 30 days notice.

6. Service Level

We strive to maintain 99.9% uptime for our services. We do not guarantee specific results from outbound campaigns, as outcomes depend on factors including market conditions, prospect quality, and your product-market fit. We provide transparent reporting on all campaign metrics.

7. Intellectual Property

You retain ownership of all data you provide to us. We retain ownership of our platform, technology, and proprietary processes. Campaign content created by our AI on your behalf is owned by you upon delivery.

8. Limitation of Liability

To the maximum extent permitted by law, SentByTed shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

9. Termination

Either party may terminate these terms at any time. Upon termination, we will cease all outbound activity on your behalf and provide you with a final performance report. Your data will be retained for 90 days post-termination, after which it will be deleted.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
